1. Ownership of Intellectual Property

All intellectual property (IP) displayed on the kovascapehomedecor.com website, including but not limited to content, text, graphics, logos, product images, product designs, icons, artwork, photographs, product descriptions, videos, and website layout (collectively, the “Content”), is the exclusive property of KovaScape Home Decor (“KovaScape”) or its licensors.

This Content is protected by United States copyright law, European Union intellectual property laws, international copyright treaties, trademark laws, and other applicable intellectual property laws worldwide.
 

2. Copyright Protection

• All original Content, including product photography of floating shelves, wooden picture frames, wall decor, and written product descriptions, is protected under copyright © [Year] KovaScape Home Decor. All rights reserved.

• You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our Content without prior written permission from KovaScape.
   

3. Trademark Rights

• “KovaScape” and all related logos, product names, slogans, and brand identifiers are trademarks and trade dress of KovaScape Home Decor, registered or common-law trademarks in the United States, European Union, and other jurisdictions.

• No person or entity may use these trademarks, in whole or in part, without KovaScape’s prior written consent, to avoid confusion, dilution, or infringement of our brand rights.
   

4. Product Design & Industrial Property Rights

• All original product designs for our floating shelves, wooden picture frames, wall decor, and home decor items are the exclusive proprietary designs of KovaScape.

• These designs are protected under industrial design rights, copyright, and trade dress laws. Any copying, imitation, replication, or use of these designs for commercial purposes is strictly prohibited and will be enforced to the full extent of the law.
   

5. Permitted Use

You are granted a limited, non-exclusive, non-transferable, revocable license to access and view the Content for personal, non-commercial use only. This license does not include:

• Resale or commercial use of the Content or products;

• Copying, reproduction, or distribution of product images, designs, or descriptions;

• Use of data mining, robots, scraping, or similar data gathering/extraction methods;

• Any modification or public display of the Content beyond personal viewing.
   

6. Prohibited Use

Any unauthorized use of the Content or our intellectual property, including but not limited to the following, is a violation of this policy and applicable law:

• Copying product images/designs for use on other websites, marketplaces (Amazon, eBay, etc.), or social media;

• Selling, manufacturing, or distributing products imitating KovaScape’s original designs;

• Using our trademarks, logos, or brand name without written approval;

• Infringing upon our copyright, trademark, or industrial design rights in any jurisdiction.
   

7. Infringement Notification & DMCA Compliance

KovaScape complies with the Digital Millennium Copyright Act (DMCA) and EU Digital Services Act (DSA). We respond promptly to valid notices of alleged copyright infringement.

To report IP infringement (copyright, trademark, or product design), submit a written notice to our designated IP agent containing:

1. Your physical or electronic signature;

2. Identification of the copyrighted/trademarked work claimed to be infringed;

3. Identification of the material that is claimed to be infringing, with URLs or sufficient location details;

4. Your contact information (name, address, phone, email);

5. A statement that you have a good faith belief the use is not authorized by the IP owner;

6. A statement that the information is accurate, under penalty of perjury, and that you are authorized to act on behalf of the owner.

8. Enforcement

KovaScape reserves the right to enforce all intellectual property rights to the fullest extent of applicable law, including civil litigation, criminal prosecution, and injunctive relief, to stop unauthorized use and protect our brand, designs, and Content.
 

9. General Provisions

Failure to enforce any right in these terms does not constitute a waiver of that right. If any provision is found unenforceable, the remaining provisions remain in full effect.
